By agreeing to these Terms and Conditions, you confirm that you have read the Airbookers.com Privacy Statement, the terms of which are incorporated herein, and agree that the terms of such statement are reasonable. You consent to the use of your personal information by Airbookers and/or its third party providers and distributors in accordance with the terms of and for the purposes set forth in the Airbookers.com Privacy Statement.

5. EXCLUSION OF WARRANTY

Airbookers and Vendors do not warrant the accuracy, reliability, completeness, or timeliness of the Content, which is subject to change at any time and may contain inaccuracies or typographical errors.

Therefore, the Web Site and Content are provided on an "As-Is" basis without any warranties of any kind, and Airbookers and third party providers and distributors disclaim, to the fullest extent permitted by law, all warranties, including the warranty of merchantability, non-infringement of third parties' rights, and the warranty of fitness for a particular purpose.

Airbookers and Vendors do not warrant that the Web Site will operate error-free or that the Web Site and its server are free of computer viruses or other harmful code. If your use of this Web Site or the Content results in the need for servicing or replacing equipment or data, Airbookers and Vendors are not responsible for those costs.

6. LIMITATION OF LIABILITY

SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL AND CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

If, notwithstanding the foregoing, Airbookers or any Vendor should be found liable for any loss or damage which arises out of or is in any way connected with any of the above described functions or uses of this Web Site or its content, Airbookers and Vendors' liability shall in no event exceed, in the aggregate, $100.00.

The laws of the state of California, United States of America, shall govern this Agreement and its performance.

9. ASSIGNMENT

You may not assign, convey, subcontract, or delegate your rights, duties, or obligations hereunder.

10. EXPORT CONTROL

The United States and other countries control the import and export of certain products and information. You agree to comply with such applicable restrictions and not to export or re-export the Content to countries or persons prohibited under any country's import or export control laws.

Additional terms and conditions may apply to reservations, purchases of goods and services, use of software, and other uses of portions of this Web Site; and you agree to abide by such other terms and conditions.

13. SEVERABILITY

These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

14. ENTIRE AGREEMENT

These Terms and Conditions contain the entire agreement between you and Airbookers and Vendors relating to the subject matter hereof, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter.

15. AGENCY FEES

Airbookers.com will charge a "Per Name" fee where a one time flat fee is assessed for each name listed as a passenger, for Air, Car and Hotel segments booked.

Example: Agency rate is 5.00 US$ per name. Eric and Fanny Perkins are taking a trip. Agency fee is 2 x 5.00 US$ for a total of 10.00 US$. This is the assessed fee regardless of the combination of segment types.
